Five Things To Know For Wednesday, April 11, 2012

2.  There was a confusing but significant argument Monday night during the Planning and Zoning Commission’s public hearing on Kobyluck Brothers LLC’s at 28 Industrial Drive.

First off, it is important to know that 28 Industrial Drive is at the end of Industrial Drive, and only has frontage on a cul-de-sac at the end of the road. Originally, the plan was to extend Industrial Drive through that piece of property.

Since Kobluck’s proposal would by action end any chance of that road going through, the company has to apply for a resubdivision, a necessary process whenever you build where a road was once planned to go, Town Planner Mark Wujtewicz said. If you apply for a resubdivision, it is incumbent on the applicant, in this case Kobyluck, to show the plan is a buildable lot, Wujtewicz said.

At Monday’s meeting, the town brought several issues with Kobyluck’s proposal. First, they argued that Waterford had not accepted the cul-de-sac as a town road, and therefore the property has no frontage on a town road, a necessary part of a buildable lot. Second, Waterford Planning Director Tom Wagner said Kobyluck’s plan was not within a buildable area, as the setbacks were not far enough away from wetlands associated with Jordan Brook.

Kobyluck’s lawyer Keri Olson argued that the town through public use accepted the cul-de-sac, something Town Attorney Rob Avena refuted. Kobyluck’s chief engineer Ellen Bartlett also said the plan showed a buildable area, but Planning Director Tom Wagner refuted that as well. The public hearing was continued until April 23 so Kobyluck could provide arguments against both allegations.
